For what purposes do we process your personal data?
We process the information provided by patients in order to facilitate the provision of the health services requested and the administrative and billing management derived from the same.
How long will we keep your data?
The personal data provided will be kept for a minimum of 15 years from the date of discharge from the last healthcare process carried out on the patient, in order to be able to meet possible claims for civil liability. Law 41/2002 of 14 November 2002, the basic law regulating patient autonomy and the rights and obligations regarding clinical information and documentation, establishes the obligation to keep medical records for a minimum of 5 years from the date of discharge from the last care process. This regulation must be complemented with the provisions of the applicable autonomous community regulations. In the event that there are regional regulations that establish the obligation of periods longer than 15 years, this period shall be taken into account for the conservation of the data.
What is the legitimacy for the processing of your data?
The legal basis for the processing of your data is the fulfilment of a legal obligation based on the terms and conditions set out in Law 14/1986, of 25 April, General Health Law, in Law 41/2002, of 14 November, basic law regulating patient autonomy and rights and obligations regarding clinical information and documentation; as well as any regional regulations that may be applicable.
The prospective or commercial offer of products, services or discounts is based on the consent requested, without in any case the withdrawal of this consent conditioning the execution of the service provided.
Sending reminders of appointments or regular check-ups to the patient by any other means (telephone/mail/sms/messaging apps) is necessary for the satisfaction of the legitimate interest of the data controller.
Your personal data may also be used for: appointment reminders (telephone/mail/sms/messaging apps), sending congratulations, publication of images on the website, exhibition of images at conferences or courses, exhibition of images in scientific publications and sharing of images with other professionals as a clinical study case, if you have previously given your consent, without in any case the withdrawal of this consent conditioning the provision of the health service requested.
To which recipients will your data be communicated?
The data will be communicated to prosthesis laboratories for the manufacture of customised medical devices, to tax agencies that carry out tax procedures for us, to computer maintenance companies, to self-employed professionals who work in our facilities, to insurance companies in the event that we have arranged medical assistance insurance for the purpose of invoicing health care expenses and to public administrations for the fulfilment of legal obligations.
Clínica Dental Moreno-Montalvo contracts with Align Technology, Inc. for the manufacture of invisible orthodontic appliances for its patients, involving international transfers of data to the USA, based on Binding Corporate Rules, approved by the European Data Protection Committee and whose information is available at: http://investor.aligntech.com/documents.cfm.
¿Chat are your rights when you provide us with your data?
Patients have the right to obtain confirmation as to whether or not we are processing personal data concerning them. Patients have the right to access their personal data, as well as the right to request the rectification of inaccurate data or, where appropriate, to request its deletion when, among other reasons, the data is no longer necessary for the purposes for which it was collected.
In certain circumstances, patients may request that we restrict the processing of their data, in which case we will only keep it blocked for the purpose of pursuing or defending claims.
In certain circumstances and for reasons related to their particular situation, patients may object to the processing of their data, in which case we will no longer process the data, except for compelling legitimate reasons, or for the exercise or defence of any claims.
In addition to the above rights, the patient will also have the right of portability, the right to withdraw consent and the right to lodge a complaint with the Supervisory Authority. The necessary information is available to the patient at www.agpd.es.
